1. Agreement to These Terms

These Terms of Service ("Terms") govern your use of hormonespecialist.com (the "Site") and any purchase from Hormone Specialist LLC ("Hormone Specialist," "we," "us," or "our"). By using the Site or placing an order, you agree to these Terms.

Our Privacy Policy, Shipping Policy, Refund Policy, and Purchase Options Cancellation Policy are part of these Terms. If you do not agree, do not use the Site or purchase our products.

You must be at least 18 years old to purchase from us.

2. Changes to These Terms

We may update these Terms from time to time. The version posted on this page applies to your use of the Site and to orders placed on or after its effective date. Changes do not apply to orders already placed.

If you have an active subscription, we will email you about material changes before they take effect.

3. Not Medical Advice

Our products are dietary supplements. These statements have not been evaluated by the Food and Drug Administration. Our products are not intended to diagnose, treat, cure, or prevent any disease.

Content on the Site, our blog, emails, social media, and other educational materials, including content from Layne Kilpatrick, is for general educational purposes only. It is not medical advice and is not a substitute for care from a qualified healthcare provider. Using the Site or our products does not create a pharmacist-patient, physician-patient, or other healthcare relationship.

Talk with your healthcare provider before starting any supplement, especially if you are pregnant or nursing, take prescription medication, have a medical condition, or are scheduled for surgery. Individual results vary.

4. Product Use and Safety

Use our products only as directed on the label, and do not exceed the suggested use. Read the full ingredient list before use. Some products contain fish or other potential allergens.

Keep all products out of reach of children and store them as the label directs. Stop use and contact a healthcare provider if you have an adverse reaction.

Formulas, ingredients, and labels may change over time. The label on the product you receive is the authoritative description of that product. Certificates of Analysis for our product lots are available at hormonespecialist.com/pages/coa.

5. Orders, Pricing, and Availability

When you place an order, you are offering to buy the products in your cart. We accept your order when we ship it. Your order confirmation email confirms that we received your order, not that we accepted it.

We may refuse, limit, or cancel any order, including for suspected fraud, suspected resale, pricing or product errors, or limited stock. If we cancel an order after charging you, we will refund the full amount charged.

Prices are in U.S. dollars and may change without notice. We work to describe products and prices accurately, but errors can happen. We may correct any error, including after an order is submitted. We may limit quantities per order, customer, or household. We currently ship to [the United States only].

6. Payment and Taxes

You authorize us and our payment processors to charge your selected payment method for the full order total, including product price, applicable taxes, and shipping. You confirm that you are authorized to use that payment method and that the information you provide is accurate.

7. Subscriptions

Some products are available by subscription. By choosing a subscription, you agree to the following:

  • Automatic renewal. Your subscription renews automatically at the frequency you select until you cancel.
  • Recurring charges. You authorize us to charge your payment method each cycle at the subscription price shown at checkout, plus applicable taxes and shipping.
  • Cancel anytime. You can skip, change, or cancel through Manage My Subscription in your account, or by emailing support@hormonespecialist.net. To avoid the next charge, cancel at least [X] days before your next billing date. Orders already processed are handled under our Refund Policy.
  • Price changes. We will notify you at least [X] days before any price change applies to your subscription.
  • Failed payments. If a payment fails, we may retry the charge, pause your subscription, or cancel it.

8. Shipping, Title, and Risk of Loss

Shipping is handled as described in our Shipping Policy. Title to products and risk of loss pass to you when we hand your order to the carrier.

We are not responsible for packages that are lost, delayed, misdelivered, or stolen after carrier handoff, or for delivery problems caused by an incorrect address. We will help with carrier claims as described in our Shipping Policy.

9. Returns, Refunds, and Our Guarantee

Returns, refunds, and our 60-day money-back guarantee are governed by our Refund Policy.

10. Site Content and Intellectual Property

The Site and its content, including text, images, videos, product names, logos, and the Hormone Specialist name, are owned by us or our licensors and protected by intellectual property laws.

We grant you a limited, revocable, non-transferable license to view the Site for your personal, non-commercial use. You may not copy, modify, distribute, sell, republish, or create derivative works from Site content without our written permission.

11. Prohibited Uses and Resale

You agree not to:

  • use the Site for any unlawful or fraudulent purpose;
  • interfere with the Site's security or operation, or attempt to access it without authorization;
  • scrape, crawl, or harvest Site content or data by automated means;
  • provide false information or impersonate another person.

Our products are sold for personal use only. Resale, including on Amazon or other online marketplaces, is prohibited without our written authorization. We may cancel orders we reasonably believe are intended for resale. Businesses interested in carrying our products can apply through our wholesale page.

12. Reviews and Submissions

If you post a review, comment, or other submission, it must be honest, based on your own experience, and lawful. If you received free product or other compensation, you must disclose that in your review.

You grant us a non-exclusive, royalty-free, perpetual license to use, display, and reproduce your submission in connection with our business. We will not edit a review in a way that changes its meaning. We may remove submissions that are unlawful, harassing, obscene, unrelated to our products, or contain someone's personal information.

The Site may link to third-party websites or use third-party services. We do not control and are not responsible for their content, products, or practices. Your use of them is at your own risk and subject to their terms.

14. Communications and Text Messages

By placing an order, you agree that we may email you about your order, shipping, and account.

If you sign up for marketing emails, you can unsubscribe at any time using the link in any email.

If you opt in to text messages, you agree to receive recurring automated marketing and order-related texts from us at the number you provide, including cart reminders. Consent to texts is not a condition of purchase. Message frequency varies, and message and data rates may apply.

Reply STOP to any text to opt out, or HELP for help. We are not responsible for delayed or undelivered messages. We share your text opt-in information only with the messaging providers that operate our program, as described in our Privacy Policy.

15. Disclaimer of Warranties

Except as expressly stated in these Terms, on the product label, or in our Refund Policy, the Site and our products are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee any particular result from using our products.

Some jurisdictions do not allow the exclusion of implied warranties, so some of these exclusions may not apply to you.

16. Limitation of Liability

To the fullest extent permitted by law, Hormone Specialist and its owners, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or our products.

Our total liability for any claim relating to a product is limited to the amount you paid for that product. Our total liability for any other claim relating to the Site is limited to $100.

Nothing in these Terms limits liability that cannot be limited under applicable law.

17. Indemnification

You agree to indemnify and hold harmless Hormone Specialist and its owners, officers, employees, and agents from claims, losses, and expenses, including reasonable attorneys' fees, arising from your violation of these Terms, your misuse of our products, or your unauthorized resale of our products.

18. Disputes, Arbitration, and Governing Law

If you have a concern, please contact us first at support@hormonespecialist.net. Most issues can be resolved quickly this way. Before filing any claim, you agree to give us 30 days to try to resolve it informally.

Agreement to arbitrate. If we can't resolve a dispute informally, you and Hormone Specialist agree to resolve any dispute arising from or relating to these Terms, the Site, or our products through binding individual arbitration instead of in court. Arbitration will be administered by the American Arbitration Association under its Consumer Arbitration Rules, before a single arbitrator, and is governed by the Federal Arbitration Act. Hearings take place in Utah or, at your choice, by phone, video, or written submissions. Fees are allocated under the AAA's Consumer Arbitration Rules.

Exceptions. Either party may bring an individual claim in small claims court. Either party may also ask a court to stop infringement of its intellectual property.

Your right to opt out. You may opt out of arbitration within 30 days after your first purchase. Email support@hormonespecialist.net or mail the address under Contact Us with your name, your address, and a clear statement that you do not want to resolve disputes through arbitration. Opting out will not affect your relationship with us.

Class action waiver. You and Hormone Specialist may bring claims only in an individual capacity, not as a plaintiff or class member in any class, consolidated, or representative proceeding. The arbitrator may not consolidate claims or preside over any class or representative proceeding. If this waiver is found unenforceable for a particular claim, that claim will proceed in court, not in arbitration.

These Terms are governed by the laws of the State of Utah, without regard to its conflict of law rules. Any claim not subject to arbitration, including a claim by a customer who opted out, must be brought in the state or federal courts located in Utah County, Utah, and you consent to their jurisdiction.

19. Privacy

Our Privacy Policy explains how we collect, use, and share your personal information, including sharing your name and shipping address with carriers to deliver your orders.

20. General Terms

These Terms, together with the policies named in Section 1, are the entire agreement between you and us about the Site and your purchases. If any provision is found unenforceable, the rest remain in effect. Our failure to enforce any provision is not a waiver.

We may assign these Terms in connection with a merger, acquisition, or sale of assets. We are not responsible for delays or failures caused by events beyond our reasonable control, including carrier disruptions, supplier shortages, and natural disasters.

These Terms will not be interpreted against us because we drafted them. Sections 15 through 18, and any other provisions that by their nature should continue, survive the end of your use of the Site or any subscription.
